ENTIRE AGREEMENT

By accepting delivery of any product delivered from PowertravellerUSA.com. ("PowertravellerUSA.com "), you ("Customer") agree to be bound by the terms and conditions listed below. You and PowertravellerUSA.com agree that the following terms and conditions are the exclusive terms governing the sales transaction between Customer and PowertravellerUSA.com. Any attempt to alter, supplement, modify or amend these terms and conditions by the Customer will be considered a material alteration of this agreement and, therefore, are null and void. PowertravellerUSA.com reserves the right to change this Agreement or terminate access to this Site at any time, with or without notice. Your use of our Site after such a change constitutes acceptance of the most current version of this Agreement. Therefore, please check these terms and conditions carefully each time you place an order with or accept delivery of any goods from PowertravellerUSA.com. If you do not agree to this Website Agreement and Terms of Use (this "Agreement"), please exit the Site immediately and do not use or purchase products from our Site.

 Refund Guarantee: 

PowertravellerUSA.com offers our customers a 30-day (30 days from the original invoice date) satisfaction replacement or refund guarantee on all purchases, except: Bulk Items We are unable to accept Bulk Items for return or replacement. We urge you to examine your product(s) upon arrival to ensure appropriate condition, before signing for the package. To take advantage of PowertravellerUSA.com 's return guarantee policy, Customer agrees to comply with PowertravellerUSA.com 's Product Return/Exchange Procedure set forth below. Any breach of PowertravellerUSA.com 's Return/Exchange Policy Procedure will result in the loss of PowertravellerUSA.com 's return/exchange guarantee. Furthermore, all return shipments not in compliance with these instructions will be rejected. 

Product Return Procedure: 

To return a product based upon PowertravellerUSA.com 's return/exchange guarantee, you must fill out the Return/Exchange Authorization form and submit it to our Returns Department in order to obtain a Return Merchandise Authorization ("RMA") number within the guaranteed return period for the product(s) (described above).
PowertravellerUSA.com will not accept returns without prior authorization and an RMA number. Once issued, RMA numbers are valid for 10 days within which the product(s) must be returned to PowertravellerUSA.com as per the email instructions sent to you. RMA numbers will not be extended or reissued. Customer should prominently display the RMA number(s) on the shipping label of boxes containing the returned product(s).

Customer is solely responsible for shipping any returned product(s) to PowertravellerUSA.com. Customer agrees to use only reputable carriers capable of providing proof of delivery and insurance for the entire value of the shipment. Customer agrees to bear all shipping charges and all risk of loss for the returned product during shipment. Customer agrees that all returned products will be 100% complete, in re-saleable condition, and will include the original packaging material, manuals, blank warranty cards, and other accessories provided by the manufacturer. If any component of the returned product(s) is missing and/or damaged, PowertravellerUSA.com's Return Procedure will be breached and PowertravellerUSA.com will reject the entire return or may choose to impose additional charges against the customer for replacement of the missing and/or component(s). 

PowertravellerUSA.com will not refund to Customer the original shipping charges or the PowertravellerUSA.com shipping charges incurred during the RMA process. Products being returned for a refund must be received by PowertravellerUSA.com prior to 10 days from the original invoice date. Returns received after the 30 day return period will no longer be eligible for refund. PowertravellerUSA.com reserves the right to refuse service to anyone.

Warranties:

PowertravellerUSA.com is a distributor only. Products sold by PowertravellerUSA.com are not manufactured by PowertravellerUSA.com. The products may, however, be covered by each manufacturer's warranty, service, and support policy (if any). PowertravellerUSA.com assigns and passes through to the Customer any warranty of the manufacturer, and Customer acknowledges that it shall have recourse only under such warranties and only as against the manufacturer of the products. PowertravellerUSA.com MAKES NO REPRESENTATION OR EXPRESS WARRANTY WITH RESPECT TO THE PRODUCT EXCEPT THOSE STATED IN THIS DOCUMENT. PowertravellerUSA.com DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, AS TO ANY SUCH PRODUCT, INCLUDING AND WITHOUT LIMITATION TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY IMPLIED WARRANTIES ARISING FROM STATUTE, TRADE USAGE, COURSE OF DEALING, OR COURSE OF PERFORMANCE. 

Limitation of Liability:

IN ALL CIRCUMSTANCES PowertravellerUSA.com's MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS SOLD. PowertravellerUSA.com SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. PowertravellerUSA.com SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT PowertravellerUSA.com IS APPRISED OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.

Any materials submitted by users of our Site, including but not limited to e-mail, product reviews, postcards, discussion submissions, and traditional mail become the sole property of PowertravellerUSA.com. Users are prohibited from submitting content to this Site that is, or may be illegal, threatening, obscene, harassing, defamatory or injurious to third parties. PowertravellerUSA.com will not tolerate solicitations, spamming, chain letters or software viruses on the Site. In addition, we ask that you not send us creative ideas, inventions, or similar materials. Any materials you do provide or submit to PowertravellerUSA.com will be the property of PowertravellerUSA.com, and PowertravellerUSA.com reserves the right to use any such material submitted as well as the right not to use that material. Content submitted by users of the site might be posted in whole or in part to PowertravellerUSA.com. Description: Products are described as accurately and appropriately as possible in order to ensure that a customer understands the product(s) they are ordering.
Color: Colors are represented as realistically as possible, but color variations of product images or color swatches are outside of the control of PowertravellerUSA.com because software, hardware and Internet connections can alter the appearance of colors.
If you are unsatisfied with a product you ordered, your sole remedy will be to return the product to PowertravellerUSA.com. 

Corrections:

While we make every effort to ensure the accuracy of product and price information, errors do occasionally occur. We reserve the right to correct any errors or inaccuracies at any time. PowertravellerUSA.com will not be held responsible for product revision changes. We apologize for any inconvenience this may cause. If you are not completely satisfied with your purchase, you may return it for a refund. 

Risk of Loss:

All purchases from PowertravellerUSA.com are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to Customer upon our delivery to the carrier. 

Damaged or defective items:

If you receive a damaged or defective item from PowertravellerUSA.com, you must contact us: (877-886-2646) within 24 hours of delivery. We will then contact the product manufacturer and send you a replacement item at no extra charge. Customer must return the defective item(s) to PowertravellerUSA.com pursuant to our Return/Exchange Policy. 

General terms & Conditions:

 
Payment Terms and Orders: An order is not binding upon PowertravellerUSA.com until it is accepted; PowertravellerUSA.com must receive payment before it will accept an order. Payment for product(s) ordered is due prior to shipment. Customer can make payment by credit card, or some other method prearranged with PowertravellerUSA.com.  You agree to pay the amount(s) due as specified on the invoice, and you agree to pay interest on all past-due sums at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater. 

Fax Authorizations: 
The following items must be included in your fax:

Copy of the credit card (front and back).

Copy of a valid, government issued picture ID

A statement reading "I authorize PowertravellerUSA.com to charge my card for the full payment amount due and to ship my order to: [INSERT YOUR SHIPPING ADDRESS]. My payment billing address is: [INSERT YOUR BILLING ADDRESS]

Shipping Charges: 
Your total cost for the purchase of any product will include shipping and handling charges shown on the PowertravellerUSA.com invoice. 

Price Protection: 
Our website is updated frequently to ensure that you'll view the latest products and pricing available, and that you receive all of the latest savings. At the time you make a purchase, you agree to the listed price. We are unable to make price adjustments if the price has changed after an order has shipped. However, if you notify PowertravellerUSA.com prior to the shipment of your order, we would be happy to make the price adjustment for you. Unfortunately, PowertravellerUSA.com does not offer competitor price matching. 

Security: 
All on-line transactions are sent through a secure server and encrypted with 256-bit SSL technology. Once we receive your information through the internet, only trusted, authorized PowertravellerUSA.com employees will process the payment to ensure that your information is handled with the utmost level of security. 

Fair Credit Billing Act: 
We guarantee that every online transaction you make will be 100% safe. This means you pay nothing if unauthorized charges are made to your card as a result of shopping at our online store. Under the Fair Credit Billing Act, your bank cannot hold you liable for more than $50.00 for fraudulent charges. If your bank does hold you liable for any of this $50.00, we will cover the entire liability for you, up to the full $50.00. We will only cover this liability if the unauthorized use of your credit card resulted through no fault of your own from purchases made while using our secure server. In the event of unauthorized use of your credit card, you must notify your credit card provider in accordance with its reporting rules and procedures. 

Sales Tax: 
Sales tax is only required for orders shipping within our resident states of business. Therefore, all orders shipping within New York State will be charged applicable sales tax according to your local area tax rate. 

Duty Tax: 
Orders shipped to international addresses please contact us at info@powertravellerusa.com or call us 877-886-2646 for any questions.  You will be responsible for any applicable duty charges. 

Change Orders: 
You may request a change to your order provided the order has not already been shipped. Please emailinfo@powertravellerusa.com or call 877-886-2646 to request a change to your order. Please have your invoice number ready when you call us to ensure the fastest service. 

Cancel Orders: 
You may request than an order be cancelled provided the order has not already been processed and shipped. Please email info@powertravellerusa.com or call 877-886-2646 to request an order cancellation. You will receive a credit for the full amount to your credit/debit card in approximately 2-4 business days. If you request to cancel an order that has already shipped it will be treated as a return and will be subject to our return policy. If you request to cancel an order that has already shipped under a free shipping offer, you will be charged actual shipping charges incurred by PowertravellerUSA.com to ship your order. 

Governing Law and Jurisdiction: 
Any dispute arising out of or related to these Terms and Conditions or the sales transaction between PowertravellerUSA.com and Customer shall be governed by the laws of the State of New York, without regard to its conflicts of law rules. Specifically, the validity, interpretation, and performance of this agreement shall not be governed by the United Nations Convention on the International Sale of Goods. PowertravellerUSA.com and Customer consent to the exclusive jurisdiction and the venue of the State Courts of the State of New York, to resolve any dispute between them related hereto, and the parties waive all rights to contest this exclusive jurisdiction and venue of such Courts. Finally, the Customer also agrees not to bring any legal action, based upon any legal theory including contract, tort, and equity or otherwise, against PowertravellerUSA.com that is more than three (3) months after the date of the applicable invoice. 

Severability: 
If any provision contained in this agreement is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions of this agreement, and the invalid, illegal, or unenforceable provision shall be deemed modified so as to have the most similar result that is valid and enforceable under applicable New York law. 

Waiver: 
The failure of either party to require performance by the other party of any provision of this agreement shall not affect in any way the first party's right to require such performance at any time thereafter. Any waiver by either party of a breach of any provision in this agreement shall not be taken or held by the other party to be a continuing waiver of that provision unless such waiver is made in writing. 

Entire Agreement:

 
These terms and conditions, together with the PowertravellerUSA.com's invoice respecting the products ordered by Customer, are the complete and exclusive agreement between PowertravellerUSA.com and Customer, and they supersede all prior or contemporaneous proposals, oral or written understandings, representations, conditions, warranties, and all other communications between PowertravellerUSA.com and Customer relating to the subject products. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage.
